Inclusive workspaces are the goal of the New York City Commission on Human Rights‘ new laws. This commission set new laws on gender identity and expression. These rules prohibit discrimination based on gender identity or expression. They mandate that employers use an individual’s chosen name and pronouns, regardless of their legal name or gender marker.
Height and Weight Discrimination
There are no height and weight discrimination may not be explicitly addressed in NYC or NYS laws. Employers’ policies and practices may require attention to this factor of a candidacy, so long as they do not affect groups based on protected characteristics. That said, height and weight requirements should be job-related and consistent with business necessity.
Dress Codes and Non-Binary Identities
Adherence to dress codes may be related to employees’ gender identities in the workplace. Chiefly, working professionals challenging traditional dress codes must be able express their gender identity without fear of discrimination or harassment, according to new laws set by the New York City Commission on Human Rights. Therefore, this is also a factor related to inclusive workspaces.
NYS and NYC Protections for Transgender and Gender Non-Conforming Workers
Both NYS and NYC expanded protections for transgender, non-binary, and gender non-conforming workers. Employers should familiarize themselves with these protections, which encompass areas such as restroom and locker room access, health care coverage, and protection against discrimination and harassment.
